Transferring An Electronic Title

Florida Title Transfer SELLER Instructions

If you want to give someone a vehicle or mobile home and you hold an electronic title for it, you and the recipient can agree to transfer the state title electronically. Both of you need to go to the local tax collector’s office to fill out and sign a secure reassignment document that states the vehicle’s odometer reading. Otherwise, pay a small fee to have the electronic title printed and mailed to you. Use the Fast Title option at your local tax collector office to get the paper title printed while you wait.

Its a good idea to read these instructions, locate all the appropriate lines on the title, and read any instructions on the title before you start filling in information. Kentucky titles were reformatted in 2000. As a result, where you sign the title depends on the age of your title. These instructions assume the title was printed after 2000. If you have an older title, please refer to this website.

Also, note that the signatures on all Kentucky titles must be notarized. This can be done at a county clerks office or anywhere else a notary is available. Dont fill out the title until you get to the office, and bring photo identification with you. If you dont, the notary will not be able to notarize your signature.

Turn to the back of your Kentucky title and look at the top.

  • On the first line under the words Transfer of title by owner, print the name and full address of the person purchasing the car.
  • In the shaded box under that, write in the cars current mileage.
  • On the next line, which says Transferor Dealer/Agent Signature, the current owner should sign their name. Next to that, where it says Transferee Dealer/Agent Signature, the person purchasing the car should sign their name. Note that if the car is owned by two people, or two people are buying it, both people need to fit their signature on the provided line, so leave plenty of space.

What Is The Power Of Attorney

In short, a power of attorney is when a person signs over some of their rights to another person to allow them to act on their behalf. For the most part, a power of attorney can involve managing finances or selling property like cars and homes for another person.

When a person is given a power of attorney, its usually because the other person is unable to act on their own behalf. They may be too sick, mentally incompetent, physically disabled, or just too old. They need someone close to them to help them sell their vehicle.

Getting the power of attorney is usually a simple process that involves both parties signing the legal documents required by the state. In these documents, its clearly specified whos giving up their rights/control and whos receiving them/it.

You and the person you intend to sell the car for will both sign the documents. Youll probably have to do this in front of a notary.

Whats a notary? A notary is a government employee responsible for witnessing the signing of legal documents.

Once you have the power of attorney for your loved one, you have the right to sell their vehicle for them. By signing the document, they entrusted you with this process. Youre now legally responsible but also protected.

When Selling A Car The Power Attorney Helps Protect Both Parties The Buyer And The Seller

The power of attorney also protects the new buyer of the car. In normal scenarios, the title of the car is transferred over to the new buyer and the deal is closed. End of story.

If you were to sell the car on someone elses behalf without the power of attorney, the actual owner of the car could turn around and claim you didnt have the right to sell the car.

In that case, there becomes a huge legal issue.

The seller can claim they didnt want their car sold and the buyer can claim the car as their own since they have the title. Legally speaking, you didnt have the right to transfer the title.

Its a mess and its a situation you dont want to find yourself in.
