Drivers Without Insurance And Tax

Wrongfully towed? How to get your money back

It’s against the law to own and use a car without insurance or tax, unless the registered owner of the car officially declares that the car is permanently off the road and not being driven. To do this, the owner must fill out a Statutory Off Road Notification and send it to the DVLA.

Under what’s called ‘continuous insurance enforcement’, the DVLA works with the Motor Insurance Bureau to identify uninsured drivers.

The DVLA reminds drivers to get insurance and tax. If they don’t, the DVLA can give them a £100 fixed penalty notice and clamp their car. Or the DVLA can take drivers to court, with a maximum fine of £1,000.

The police and local council can also clamp or get cars towed away if their owners haven’t paid tax or insurance.

What Should I Do If My Car Has Been Towed

Can A Police Officer Pull You Over For No Insurance

Officers may have the upper hand now when it comes to determining if a driver has insurance, but in no way does that mean that its okay for the officer to pull someone over just because they see a car with expired insurance in the computer system.

Driving without insurance is a secondary violation. This means that the officer must have a valid reason to stop the vehicle before the driver is cited for having no insurance. It could be a moving violation or suspicion of criminal activity. This said, its not nearly as hard as you might think for an office to find a reason to pull vehicle owners over if they want to. Some cops have been known to issue tickets for things like going 1 mph over the speed limit.

Why Was My Car Towed

There are several reasons why a vehicle is towed in Washington State, even if the driver was powerless to prevent it. Lets say the car or truck ran out of gas on the side of a highway. For whatever reason, the driver needs to walk to a gas station to get some gas.

If a law enforcement officer comes on the scene, they may just leave a sticker on the car notifying the owner they have 24 hours to remove it. Chances are, the driver will be back with more gas or help later that day. If thats the case, theres no issue.

A tow truck will be called immediately if the car is parked in an unsafe manner or obstructing the public right of way. The vehicle owner will be required to pay for the towing and storing of the car at this point.

The situation may have been out of their control, but they are still responsible to do what they can to leave the car in a safe position.

Can The Storage Company Auction Off My Car

Yes. The storage company must notify you twice that your car is in storage. A vehicle must be on the lot for at least 24 hours before the first notice is sent. If the vehicle is registered in Texas the notice must be sent no later than the 5th day it is on the lot. If the vehicle is registered in another state, the notice must be sent no later than the 14th day the vehicle is on the lot. The second notification must be sent between the 15th day and the 20th day after the date the first notice was mailed or published.

If you dont claim your car within 31 days of the storage company sending you a 2nd written notice, the car can be sold at auction. If you dont have the correct address on your registration, you might not get the notice. But under some circumstances the vehicle can be classified as “junk” and the storage company can get authority to demolish it on the 10th day after the first notice has been sent to you.

You legally have to have insurance to drive your vehicle on the street or the highway. There are very few private roads that youre allowed to drive on with no insurance and even fewer states in the U.S. without some kind of mandatory insurance requirement.

If youre going to own a vehicle, its your duty as a property owner to find out what the laws are in your state before you register it in your name.

Mandatory insurance requirements vary by state and the insurance system the state operates under. At this current time, there are two types of insurance systems: tort systems and no-fault auto insurance systems.

Tort systems require the at-fault driver to compensate drivers, passengers, and pedestrians for damages after a loss.

While its more common for a state to operate under tort law, theres still a chance that the legislation passed in your state will make no-fault coverage mandatory.

When theres some type of modified no-fault system in place, it doesnt mean that no one is at fault for an accident, it just means fault doesnt determine which insurer pays. Heres a list of common requirements:
