How To Get An Abandoned Car Towed

As long as the vehicle is definitely on your private property and has been there for the amount of time allotted by your local government that classifies it as abandoned, you can have it towed. Some will do it for free as long as they can claim the vehicle, but others will charge you a fee. If the owner of the car, truck, motorcycle, boat, RV, or whatever was left on your property comes looking for it, you can give them the name of the tow company, and they can take it from there. Remember, its essential to investigate the laws so people cannot make a claim against you in court!

Dealing With Vehicles Parked In City Streets

When it comes to dealing with possibly abandoned vehicles, the first thing a person should do figure out what the local laws. Many cities and counties have their own laws regarding abandoned vehicles. Usually, the laws or ordinances define a vehicle as being parked on a city street for too long if the vehicle has been there for more than 72 hours.

The laws can also vary depending on if the vehicle is disabled, such as not having an engine, or if the vehicle is an RV or camper. Typically disabled vehicles are required to be either in a structure, such as a garage, or in a fenced yard.

The best place to look these laws up is checking the city or countys website.

If a person lives in an apartment complex, or in a neighborhood with a homeowners association, they should look up the rules for the area. They may find something there that prohibits cars from being left out on the street for extended periods of time.

Despite a cars usefulness, some people will simply abandon the vehicle once it stops working for them. If a person thinks that has happened near them, and the vehicle is in the way, they should look into local laws. Once they have done that, they can begin to determine if the car has truly been abandoned and if the local authorities need to be contacted. From there, the local police or sheriffs will be able to handle the situation.

Determine Whether The Vehicle Is Abandoned

If none of your neighbors or nearby business owners know who owns a car that has been on your street for days now, you can probably assume it’s abandoned. That’s especially true if the vehicle is in bad shape, with major parts missing, flat tires, or expired license plates.

In such a case, contact local law enforcement via their non-emergency number, or check whether your city has an online reporting system for such issues.

Looking Into Local Laws On Abandoned Vehicles

Your first task is to check local rules regarding vehicle parking on city streets . Almost all cities prohibit leaving any vehicle parked on a city street too longoften defined as more than 72 hours.

Also check ordinances regarding disabled vehicles . Typical ordinances require disabled cars to be either put into an enclosed structure, such as a garage, or placed behind a fence. Some ordinances limit the parking of RVs and disabled cars to 72 hours, unless they are enclosed or out of sight.

To find your local ordinance on abandoned or disabled vehicles, check your city or county website or start at State & Local. You can also call your mayor’s or city manager’s office for advice on the issue.

Once you have the local ordinances in hand or on screen, search for “abandoned vehicles” or “disabled vehicles” or check for these topics in the index or table of contents. Read the law carefully, so you’re clear as to the rules regarding abandoned or disabled vehicles.

If you live in a condo or planned unit development, check out your homeowner association ‘s Covenants, Conditions, and Restrictions or similar rules on the subject.

If You’re A Landlord Whose Tenant Has Abandoned A Vehicle

Occasionally, a departing tenant will leave an inoperable car in the parking lot or garage. While states’ landlord-tenant laws often require landlords to provide tenants written notice that they are dealing with abandoned property, these rules don’t typically apply to motor vehicles.

If a tenant has left a car or other vehicle behind, contact the local police and give the same information you would provide if reporting another abandoned vehicle. The police will probably arrange to have it towed after tagging it and ultimately determining that it is abandoning.

See If The Vehicle Belongs To Someone In The Neighborhood

Once you know the law, see if you can find out who owns the vehicle. Perhaps it belongs to a neighbor, or a neighbor’s friend or relative, or a local business owner.

If you can’t figure this out, skip to the next section of this article.

If you’re able to find this who owns the vehicle, and it’s causing a problemfor example, by taking up a valuable parking spot in front of your homeask the owner to move it .

Give the owner a copy of local rules on the topic and hope that’s the end of the matter. It’s entirely possible that the owner is not aware of local rules or the problems caused by leaving a vehicle on the street for a long period of time.

Keep in mind, however, that anyone can park their car on a public street as long they comply with state and local vehicle codes . In particular, you have no more right than anyone else to the space immediately in front of your home.

See the book Neighbor Law, by Attorneys Emily Doskow and Lina Guillen, for advice on talking with neighbors about problems involving their cars or other issues.

If the vehicle is disabled and the neighbor refuses to deal with it, you might have to get the police or sheriff involved.

Examples Of When A Vehicle Would Not Qualify For The Abandoned Vehicle Process:

    • A person purchases a vehicle but does not have the proper documentation to complete the title transfer.
    • A vehicle is a mobile home that is 8′ x 40′ or larger.
    • A vehicle is left in a public garage or parking lot, under a written or verbal contract.
    • A vehicle is left in a self-service storage facility.
    • A historic vehicle is being stored or maintained on the vehicle owner’s private property.

    Try To Find The Owner

Once the person knows and understands the laws about leaving vehicles unattended, they should try to locate the owner of the vehicle. If the person can find the owner, they can try politely asking the person to move the vehicle because of the problems it is causing. They can also try giving a copy of the local laws or ordinances. Hopefully that will be the end of things. After all, the owner may not have known about the laws.

Something to remember is that a person does not have special rights to the public curb in front of their house. This means that anyone is allowed to park there. As long as that person is following the local laws, they are not required to move their vehicle just because it is in front of another persons house.

If the person is breaking a local law, and refuses to move the vehicle, or the vehicles owner cannot be located, then the person may need to contact local law enforcement.
