California Car Title: Transfer Of Ownership

The surviving spouse must fill out an Affidavit of Surviving Spouse in order to:

  • Transfer the title of the vehicle into their name or remove the name of the former spouse.
  • Sell the vehicle.

NOTE: Your insurance agent will have a copy of the Tax Exemption form and the Application for Registration and Title. The agent can fill out everything, except the signature.

Bring all documents, along with payment for the title fee and gift fee to your local MA RMV office for your new title.

Locate The Current Title

The owner of the vehicle must locate the current title of it. Without a valid title of a car, the car cannot legally be sold. Car owners who have lost their titles or their titles became damaged can apply for lost titles for a fee from the Department of Motor Vehicles where the original car title was issued to them.

Transferring A Title To Family Members

You can give a vehicle as a gift to a family member, who may be exempt from paying taxes on it. The receiving family member must complete and submit a Sales Tax Exemption form MVU-26 to determine whether he or she will need to pay taxes on the vehicle.

This exemption exists only for immediate family members, which are designated as:

  • Parents
  • Spouses
  • Siblings

The process follows the same steps found in the Selling a Vehicle section listed above, with one difference: instead of a purchase price, write “Gift” in the price section or on the Bill of Sale.

    Buying From A Private Individual

    If the vehicle is exempt from having a title due to age:

    • Get from the seller the vehicle’s latest registration certificate.
    • Have the seller make out a bill of sale, as described above.

    Take all the documents to your local MA RMV office along with payment for the following fees:

    • $75 title fee.
    • 6.25% sales tax.
    • Any possible additional fees based on the type of vehicle, or if you opt for specialized license plates.

    If youre financingeither because there is still a lien on the vehicle from the original purchase or because you took out a loan to pay the sellerthe lienholder must be added to the title. You can do this yourself, or you can have the DMV take care of it.     Its a good idea to read these instructions, locate all the appropriate lines on the title, and read any instructions on the title before you start filling in information. Note that Nevada has changed the layout of their titles several times, so if your vehicle hasnt changed hands in a long time, your title may look different than the one described here.

    Look for the following information near the bottom of the front of your Nevada car title.

  • Where it says Printed full legal name of buyer, print the buyers name. Next to that, print the buyers Nevada drivers license or identification card number.
  • If a second persons name will appear on the title, print their full name and drivers license/identification number on the next line.
  • Write the buyers full address in the appropriate places on the next line.
  • On the short line underneath, write the vehicles current mileage.
  • On the next line, the seller should sign their name. Note that if two people own the vehicle, both people must fit their signatures on this line. On the line immediately next to this one, the seller should print their name.

    To transfer a car title in Hawaii, the seller needs to be fill out information on the front of the document. The buyer needs to fill out information on the back.

  • On the front of the title, near the middle, the seller must write in the current odometer reading on the vehicle.
  • Near the bottom, the seller must fill in the following information on the appropriate lines: Date the vehicle was sold, and their printed name and signed name .
  • If the vehicle is also owned by a second person, that person can print and sign their name on the line right below.
  • Turn the title over. On the back, in Section D, the seller should fill in the following information on the appropriate lines:
    • Their printed last name, first name, middle initial and sale date of the vehicle.
